Registered Trademark
‘Tensing’ is a protected and registered trade name, on which an exclusive right of usage applies. Tensing b.v., having its registered office at Wielkamp 3, Zaltbommel, with trade number 16064394, has deposited and registered the name ‘Tensing’. The trade name ‘Tensing’, is registered, or is the subject of a register procedure at the moment, in the following countries: The United States of America, Canada, South-Africa, Australia and the Benelux.

It is not permitted for any third party, whether a corporation, a natural person or an entity in whatsoever (legal) form, to infringe the trade name of Tensing b.v. Parties should be aware of the fact that by infringing the trade name, whether or not in good faith, they act unlawful with regard to Tensing b.v.

Tensing b.v. uses a trade name surveillance of Merk-Echt BV, having its registered office in Breda with trade number 24279054, to monitor whether there has been any infringement by any third party of our trade name, so that we are able to react directly and adequately and take measures against such party.

Liability
Third parties are liable for any infringement on the trade name of Tensing b.v. In the event of an infringement Tensing b.v.is entitled to take proper measures, including but not limited to claim indemnification for the infringement, in addition to any other remedy which may be available in law or in equity. Disputes which arise from an infringement by third parties shall be settled in a court of law with proper jurisdiction within the Netherlands.

Procedure
In the event Tensing b.v.has founded that a third party infringes the exclusive right of usage with regard to the trade name ‘Tensing’, Tensing b.v. shall in writing urgently request that party to end its unlawful actions within a short period of time. In case the infringing third party does not respond to this written notice and continue its unlawful actions, Tensing b.v. is entitled to start a judicial procedure and claim indemnification, which leaves any other remedy unimpeded where Tensing b.v. is entitled to.

The law of the Netherlands shall apply on all the above stated.
